Section i — ScopeWhat these terms cover.
These terms govern your use of impartialdraw.co and any purchase of trading cards or related product that follows from being drawn in a Impartial Draw cut. They are an agreement between you and Impartial Draw, based in Northbrook, Illinois, USA. A formal business entity is to be registered ahead of launch; once it is, this section will name it.
Impartial Draw aims to be an approved retailer of official trading cards. Today, the storefront is in stage one of three: gathering pledges only — no sales, no draws, no live service. Once approved as a retailer (stage three of three), we will source units in bulk through a sanctioned wholesale distributor and sell them to drawn buyers at near MSRP. We are not a card publisher; we are not a distributor. For each release we open, we will stock units in bulk on our own account, run a fair draw against the verified pledges for that release, and complete the sale to the drawn buyers ourselves. By verifying, pledging, or completing a purchase, you confirm that you have read and agreed to these terms, and that you have read the plain-English summary above. If anything in the longer text below conflicts with the summary, the summary wins.
Section ii — EligibilityWho may pledge.
To register a pledge, and (when asked at draw) to verify identity and enter a draw, you must be all of the following:
We may refuse a verification, void a pledge, or cancel a purchase at our reasonable discretion if any of these cease to be true — for example, if your address turns out to be a freight-forwarder or a known reseller node. We will tell you why, in writing, and refund anything you've paid.
Section iii — IdentityIdentity verification.
Identity verification is conducted by Stripe, Inc.through its Stripe Identity product (“Stripe Identity”), our independent verification provider. Verification is not required at pledge. Impartial Draw writes to the pledge members for a release at the time we open it for draw, and asks them to complete the Stripe Identity check at that point. Stripe checks your government-issued ID against itself, and a brief selfie against the document. The check confirms (a) the document is genuine, (b) the document is yours, and (c) the holder is over 18.
Impartial Draw receives only a pass / fail signal, the name on the document, the date of birth (used only for the 18+ check), and the country of issue. Your ID images and selfie are processed by Stripe and are not retainedby Impartial Draw at any point. Stripe's own retention policy is set out in its privacy noticeand is governed by Stripe's terms.

Section iv — PledgesPledges & the draw.
A pledge is a free signal of intent, from a registered Impartial Draw account, to buy a specific upcoming release at near MSRP should Impartial Draw stock the release and open it for draw. A pledge is not a purchase, a preorder, or a reservation. No money changes hands at pledge. There is no fee, charge, or hold on your card. Identity verification is not required to register a pledge.
When Impartial Draw opens a release for draw, we write to the pledge members for that release with a Stripe Identity link. Verification through Stripe is required at that gate to enter the draw — only at that point, and only once across all future cuts.
You may place one pledge per release, no limit on releases. If you attempt to pledge the same release more than once, the first pledge stands and the rest are voided without prejudice. Pledges are personal and non-transferable. You may withdraw a pledge at any time before the draw runs.
Impartial Draw maintains an append-only, signed pledge ledger and uses the aggregated counts to decide which releases to stock and in what quantity. We are under no obligation to stock any particular release; we are not required to fulfil a pledge for which we cannot secure stock through our wholesale channel. If a release reaches end-of-life without us being able to stock it, the pledge closes out with a note and you are not charged.
When Impartial Draw opens a release for draw with n units, the draw runs against a future round of the drand public randomness beacon, the round number for which is committed at the time we open and is published on impartialdraw.co/audit. The seed cannot be known by anyone — Impartial Draw included — until the round releases.
The names of drawn buyers, in the order they were drawn, are determined by sorting all pledges ascendingly by SHA-256(seed + pledge_id) and taking the first n entries for that release. The full algorithm, the published seed, and the redacted pledge log are made available within 12 hours of the draw, so that any third party may verify the result.
Section v — Being drawnIf you're drawn.
If your pledge is drawn, you will receive a confirmation email within one hour of the draw closing, together with a private link to complete the purchase at near MSRP. You have 24 hours from the time the email is sent to confirm and pay; the deadline is stated on the link.
If you do not complete the purchase within 24 hours, your draw lapses and the unit rolls forward to the next pledge on the sorted list. You will not be charged. You retain your verification and may pledge for future releases.
Being drawn does not oblige you to buy. There is no penalty, fee, or mark against your record for declining or simply not responding. We would prefer you not waste a draw — but we will not punish you for it.
Section vi — PricingPricing & payment.
The price of any release is the manufacturer's suggested retail price (MSRP) set by the publisher, plus a small disclosed margin and any applicable shipping. The margin covers the wholesale cost of the units, handling, collector-grade packaging, and our system charge. The exact breakdown is line-itemed on the confirmation link before you commit. We do not apply dynamic pricing or buyer-specific surcharges; the price you see on the confirmation link is the price you pay.
Impartial Draw's revenue is the margin between the wholesale cost of the units we stock and the price charged to drawn buyers, less the operating costs disclosed above. We do not earn any fee at pledge, and no payment is taken from a pledge member who is not drawn or who declines to confirm.
Payment is taken at confirmation, on a private link sent to drawn buyers, by card or by bank transfer in supported regions. Payments are processed by Stripe Payments under their published terms. We do not retain your card details.
If a release is listed in error at a price that is materially lower than its intended price, we may, at our reasonable discretion, cancel the order and refund any payment in full, with our apology.
Section vii — FulfilmentFulfilment & delivery.
At launch we operate in the United Statesonly. We expect to add other regions over time as our wholesale capacity and shipping logistics allow. Region eligibility is checked at verification — if we don't operate where you live, you'll see that before pledging.
Each drawn unit is dispatched directly by Impartial Draw — packed in collector-grade packaging and sent by tracked courier with a signature on delivery, within five working days of confirmation. Loss or damage in transit is our responsibility, and is refunded or replaced at no cost to you. Impartial Draw also maintains a fulfillment reserve of unsold stock from each release to handle replacements and customer-service issues.
Section viii — ReturnsReturns & refunds.
Sealed product may be returned for any reason within thirty days from the date you receive it, in original condition and original outer packaging. We will refund the price paid to the original method of payment and pay the cost of the return label.
Once a pack, box, or tin is opened, the cards inside are yours and the unit becomes non-returnable. We do not accept returns of opened product, individual cards, or units in damaged outer packaging — collectible value depends on the seal, and we won't put a previously-opened unit back into circulation.
If a unit arrives damaged in transit, write to us before you do anything else — don't open it, don't return it. We'll sort a replacement from our fulfillment reserve or a refund directly, and pay the return label either way.
Section ix — ResaleResale & transfer.
You may resell, gift, or otherwise transfer what you have bought. We won't restrict the secondary market. We do, however, ask two things:
We will not chase secondary-market value at our buyers' expense. If a release begins trading at a multiple of MSRP on the resale market, we will ask our wholesale source for additional stock and run further draws — not undercut the buyers who already paid MSRP.
Section x — Your dataYour data.
Impartial Draw is the data controller for the personal data you give us directly — your name, email, shipping address, and the records of your pledges, draws, and purchases. We process this data to run the draw, decide which releases to stock, fulfil drawn purchases, and write to you about future releases you have asked us to write about.
We do not sell your data, ever. We do not use it for marketing beyond Impartial Draw. We do not place tracking pixels on the storefront for advertising networks. We may share data with: (a) Stripe, for identity verification and payment processing; (b) shipping couriers, for delivery; (c) our accountants and auditors, where required by law. We do not share personally identifying pledge or buyer data with our wholesale distributor; our relationship with them is a standard wholesale account.
Any pledge data we publish or present is aggregated and pseudonymous: unique-pledge counts per release, country and broad region, age band, and a hashed pledge ID for audit. Your name, email, and address are never disclosed to third parties except for the operational purposes listed above.
You may ask, at any time, for a copy of what we hold about you, for it to be corrected, or for it to be deleted — and we will action that within thirty days. See our privacy notice for the full detail.
Section xi — ConductConduct & suspension.
We reserve the right to suspend or terminate your account, void pledges, and decline future business if you:

Section xii — LiabilityLiability & disputes.
Nothing in these terms limits your statutory rights as a consumer. Where the law permits us to limit liability, our total liability to you is capped at the greater of (a) the amount you paid for the unit in dispute, and (b) one hundred US dollars.
These terms are governed by the laws of the State of Illinois and the federal laws of the United States, without regard to conflict-of-laws principles. Disputes that we cannot resolve by writing to one another may be brought before the state or federal courts located in Cook County, Illinois — or, where the law gives you the right to bring a claim in your home state, before the courts of your state of residence.
The fair-draw mechanic varies by state. If “no purchase necessary” framing or other local rules apply differently where you live, the local rule controls. We will not enforce a term against you that the law in your state says we cannot.
Section xiii — ChangesChanges to these terms.
We may revise these terms from time to time. When we do, we will write to you at the address you have given us, ahead of the change taking effect. The version that applies to any given purchase is the version published at the time you placed the pledge that led to that purchase.
Past versions of these terms are kept on impartialdraw.co/terms/archive, each numbered and dated. Nothing is quietly removed.
